I have a tenant who is in considerable arrears and is at the end of his tenancy. I need some advice on how to get my property back.
I am a LLAS accredited landlord and need some advice.

Thank you for your question in regard to getting your property back.

LLAS does not have an advice line as we do not have the resources to provide such a service and as you are aware you and all the accredited landlords & agents do not pay a yearly membership fee.

However, have you discussed with your tenant about ending the tenancy and is the tenancy coming to an end soon, or are you considering ending the tenancy because of the arrears? If yes, to last question, then you will need to serve your tenant a Sec.8 notice, Ground 8: Serious rent arrears.

This ground can be used if the tenants owe a minimum of:

  • eight weeks’ rent if they pay weekly or fortnightly.
  • two months’ rent if they pay monthly.
  • three months’ rent if they pay quarterly or annually.

It has a minimum notice period of two weeks.

I would advise you refer to the LLAS Landlord Handbook or seek the Services of a solicitor.
